That retaining wall in the backyard, holding up the neighbour's garden or your own terraced lawn, is more regulated in Western Australia than most owners realise. WA's permit threshold is lower than most other states, and a wall built without the approval or the engineering it needed is a real problem to inherit when you buy.
The 500mm threshold, and why it catches people
In WA, a building permit is generally required where a retaining wall exceeds 500 mm in height. That is lower than most other states, and it is the number that surprises people, because 500 mm is not a big wall. The threshold is measured from the finished ground level on the low side of the wall, and it applies to additions to existing walls and to tiered walls where the combined height exceeds 500 mm — you cannot avoid it by stacking two shorter walls.
There is more. Even a wall under 500 mm can require a permit where it sits close to a boundary, encroaches beyond the property, reduces the bearing capacity of an adjoining lot, affects the structural adequacy of a building, or changes the site's natural drainage in a way that affects neighbouring land. The height is the headline rule, but it is not the only trigger.
When an engineer is required
As the wall gets taller, the requirements escalate. Walls over 500 mm generally need a building permit, and walls over about a metre almost always require structural engineering drawings and certification. The relevant standard is AS 4678, earth-retaining structures. A driveway wall, which carries vehicle load, can require engineering at any height because of the surcharge it bears.
That word, surcharge, is the key structural concept. A wall designed to hold back soil only is one thing; a wall that also has to resist the load of a building footing, a driveway, a vehicle, or a fence catching the wind above it is carrying far more, and a wall built for soil only that ends up under surcharge is under-designed for its actual job.
Perth's soil makes it worse in a specific way
Much of Perth's coastal plain is loose, free-draining sand. That is good for drainage but poor for lateral resistance: sand gives a post far less grip than clay does, so posts have to be embedded deeper than a standard clay-soil specification would suggest. A wall built on the coast to an inland spec can have posts that are simply not deep enough for the ground they are in, and in the Hills the limestone brings its own challenges. Why it matters when you are buying
A failing retaining wall is expensive and, where it holds up a neighbour's land or a structure, it can become a shared and contested cost. Two things are worth knowing on a purchase.
First, whether any wall over 500 mm was built with the permit and, where required, the engineering it needed. An unpermitted structural retaining wall is unauthorised work, with the same consequences as any other — it may need to be certified after the fact or brought up to standard, which we cover in our guide on building permits.
Second, the wall's actual condition. Bulging, leaning, cracking, or signs that the ground behind it is moving are all warnings that a wall is failing or was never adequate for its load. Where a wall retains soil against a boundary, responsibility for it can be shared with the neighbour, and disputes over shared retaining walls are handled through the State Administrative Tribunal.
What an inspection reports
A retaining wall on the property is something we look at as part of the site: its condition, any lean, bulge or cracking, whether it appears to be under a surcharge it was not built for, and drainage behind it. Under AS 4349.1 we report the visible condition and significance; whether a specific wall meets AS 4678 or was properly permitted is a records-and-engineering question, and where a wall shows signs of distress or looks under-built for its load, we say so and recommend the right follow-up. A pre-purchase inspection flags the wall that is failing or unauthorised before it becomes your problem to fix.
Why the height threshold catches people
The reason a height threshold exists for when a retaining wall needs engineering and approval is that the forces a retaining wall has to resist grow rapidly with height, and a wall that is fine at a low height becomes a serious structural undertaking as it gets taller. A retaining wall is holding back a mass of soil, and that soil exerts a substantial and continuous sideways pressure that increases with the depth of soil retained. A low wall holds back little and the pressures are modest; a taller wall holds back much more, and the pressures become large enough that the wall has to be properly designed to resist them or it will fail. The threshold is set where the engineering judgement becomes genuinely necessary rather than optional, which is why crossing it changes the requirements.
What catches people is that a retaining wall does not look like a structure that needs engineering. It looks like a garden feature, a landscaping element, something a competent person could build over a weekend, and at low heights that is broadly true. But a wall above the threshold is a structural element resisting real loads, and building it without the design and approval the requirements call for means building a structure that may not be adequate for the forces it has to resist. The gap between how a retaining wall looks, a bit of landscaping, and what it actually is above a certain height, a loaded structural element, is exactly where owners and builders get it wrong, treating a wall that needs engineering as a job that does not.
How Perth's ground makes it harder
Perth's soils add a specific complication to retaining walls, particularly the drainage behind them, which is one of the most common causes of retaining wall failure everywhere but has its own character here. A retaining wall has to deal not just with the pressure of the soil but with water, because water building up in the soil behind a wall dramatically increases the pressure on it, and a wall designed and drained for dry soil can fail when water accumulates behind it. Proper drainage behind a retaining wall, allowing water to escape rather than build up, is therefore critical, and its absence or failure is behind a great many retaining wall problems.
On Perth's reactive clay soils, the water issue is compounded, because these soils swell when wet and the moisture-driven ground movement adds to the loads and the complexity a retaining wall has to manage. A retaining wall on reactive clay, holding back soil that swells and shrinks with the seasons and that can build up water pressure behind the wall, is dealing with a more demanding situation than a wall in free-draining sand, and it needs the drainage and the design to match. This is part of why retaining walls in Perth are not to be treated casually: the ground behind them, particularly on the clay soils, can impose loads and pressures that an inadequately designed or drained wall will not survive.
Why it matters when buying, and what an inspection reports
For a buyer, a retaining wall on a property is worth understanding rather than overlooking, because a failing or inadequate retaining wall can be an expensive problem and, where it retains soil near a boundary or a structure, a consequential one. The questions worth answering are whether the wall is above the height at which engineering and approval were required and, if so, whether it was properly designed and approved; whether it shows signs of distress, leaning, bulging, cracking, movement, that suggest it is struggling with the loads on it; and whether it has adequate drainage behind it. A retaining wall that is failing can threaten what sits above or below it and can be costly to rectify, so it is not a feature to take for granted.
An inspection can report the visible condition of a retaining wall, noting signs of movement, distress, or drainage problems, and can flag where a wall's height suggests engineering and approval should have been involved and where its condition warrants a closer or specialist look. What an inspection cannot do from a visual assessment is certify the wall's structural adequacy or confirm its approval history, which are matters for engineering assessment and the property records respectively. But flagging a retaining wall that is showing distress, or that is tall enough to have needed engineering, is exactly the kind of finding that lets a buyer investigate before committing rather than discovering a failing wall afterward. On a sloping Perth block with retaining walls, particularly older or tall ones on clay soils, the walls are worth this attention, because their failure is both possible and expensive.
